First of all, what is Leadlife?


Leadlife offers you a digital platform for improving your quality of life. This is made available to you via the subscription you choose within the mobile app (hereinafter: 'Leadlife App') and a personal dashboard generated from it. Through the Leadlife App and the Leadlife Webshop on the Leadlife website (hereinafter: 'Leadlife Webshop'), Leadlife offers services, products, and tracks via itself, Leadlife BV, Leadlife Partners, or independent healthcare and professional care providers. These allow you to optimally manage and improve your well-being and lifestyle. You can find and purchase these services, products, and tracks—where applicable—in our Leadlife Webshop and the Leadlife Catalogue in the Leadlife App.


These General Terms and Conditions only apply to the Leadlife Webshop.


When can you purchase the services, products, and tracks?


The services, products, and tracks offered by Leadlife can be purchased both via the Leadlife Webshop on the Leadlife Website (as well as in the Leadlife Catalogue in the Leadlife App). These General Terms and Conditions apply to purchases made in the Leadlife Webshop. For purchases made within the Leadlife App, you must refer to the terms and conditions of the Leadlife App.


Before you can proceed with the purchase of services, products, and tracks within the Leadlife Webshop, you must accept these General Terms and Conditions and our Privacy Policy for the Leadlife Webshop. Once you have completed the purchase, you will receive a code for services, products, and tracks that you must enter in the Leadlife App to access your purchased products, services, and tracks. Depending on the product, the specific product may also be sent to you or made available if you do not need to activate it first via the Leadlife App with a code. If you want to know how to use the Leadlife App, you should consult the General Terms and Conditions of the Leadlife App.




Within the Leadlife Webshop, you can purchase services, products, and tracks from both Leadlife, Leadlife BV, and Leadlife Partners. For each of the offered services, products, or tracks, you will find a Technical Sheet on the respective product, service, or track page with a more detailed description of the product, track, or service in question.


For each of the services, products, or tracks offered by a Partner, the Technical Sheet will also include the relevant general terms and conditions of Leadlife BV or the Leadlife Partner, as well as any additional provisions and conditions. An extract of the Partner's general terms and conditions, as well as other relevant information, can be found on the Partner page.


If you purchased a service and/or track, depending on the service and/or track you purchased, guidance will take place either online, at a Leadlife center, or at a location of one of our Partners.


If you want more information about the services, products, and tracks on the Leadlife Webshop, you can make an appointment through the Leadlife Website or contact a Leadlife center by phone for a non-binding conversation. This conversation can take place either physically or online. To register for such an introductory conversation, you must be at least 18 years old and provide us with certain personal information in advance. There is no obligation to make a purchase as a result of an introductory conversation.


How can you use the services, products, and tracks?


You may only use the services, products, and tracks as intended. You are jointly responsible with us for the confidentiality of your use.


The use of services, products, and/or tracks from Leadlife or Leadlife BV will always be in accordance with the general terms and conditions described in the Leadlife App's terms.

The use of services, products, and/or tracks from Leadlife Partners will always be in accordance with an extract of the general terms and conditions of Leadlife BV and the Leadlife Partner provided on the Partner page of the respective services, products, and tracks. On this Partner page, you will also find a reference to the full general terms and conditions and the contact details of the relevant Partner.


Leadlife, before entering into a collaboration with Leadlife BV and a Leadlife Partner, has a quality protocol whereby the services of Leadlife BV and Leadlife Partners will be subject to a quality control before this Partner can offer services, products, and tracks within the Leadlife Webshop.


If you violate our General Terms and Conditions, you risk no longer being allowed to use the services, products, and tracks.

Important to know


The personal data you share with us always remains your property, and you alone determine who has access to your personal data. Leadlife will only use this to provide its services, products, or tracks to you. For services, products, and tracks from Leadlife BV and Leadlife Partners that you purchase through the Leadlife Webshop, you always retain the choice of which personal data you wish to share with this Partner. Leadlife, its subcontractors, Leadlife BV, and Leadlife Partners always remain the owners of their services, products, and tracks and all related intellectual property rights.

Leadlife can only be held liable for damages that are directly attributed to Leadlife and Leadlife alone.


Any healthcare provider and (professional) care provider directly or indirectly responsible for (a part of) the service related to services, products, or tracks remains at all times liable for their professional activities and the provision of these services, products, and tracks, in accordance with their respective terms and conditions.


Our General Terms and Conditions may be updated from time to time. We recommend checking them regularly, but we will always notify you of changes, at which point you are free to decide whether you continue to use the Leadlife Webshop.

Article 1. General


The General Terms and Conditions are offered electronically. A printed version of the General Terms and Conditions is available upon request via info@leadlife.com.


The Leadlife Webshop is fully operated, and the Services, Products, and Tracks are managed and sold (distributed) by Leadlife Technologies (hereinafter: 'Leadlife').


In the Leadlife Webshop, Services, Products, and Tracks are offered by Leadlife, Leadlife Partners, and Leadlife BV, with Leadlife BV being the preferred partner.


To purchase and use Services, Products, and Tracks from Leadlife, Leadlife BV, and Leadlife Partners in the Leadlife Webshop, Customers must accept the General Terms and Conditions and the Privacy Policy before making a purchase.


It is recommended that the Customer carefully review the General Terms and Conditions and the Privacy Policy before proceeding with the purchase of Services, Products, and Tracks in the Leadlife Webshop.





These Webshop Terms and Conditions apply only to the pages on the Website belonging to the Webshop and the direct marketing performed by LEADLIFE. They do not apply to pages and websites of third parties to which LEADLIFE may refer or provide links, whose privacy policies may differ. LEADLIFE is therefore not responsible for the data on or processed by third-party websites.


Article 2. Definitions


In these General Terms and Conditions, the following terms have the meanings ascribed to them below:


General Terms and Conditions
These general terms and conditions, which govern the sale and use of the Services, Products, and Tracks of Leadlife, Leadlife BV, or Leadlife Partners in the Leadlife Webshop.


Leadlife Application
The Leadlife platform, its associated interfaces, and basic functionalities, offered as an application downloadable via iOS and Android.


Leadlife
Leadlife Technologies, the Belgian company, with its registered office at 8900 Ypres, Zwaanhofweg 10, and registered with the Crossroads Bank for Enterprises under number 0834.079.442, which offers the Leadlife Webshop and the Services, Products, and Tracks of itself, Leadlife BV, or other Leadlife Partners in the capacity of distributor.


Leadlife BV
Leadlife BV, the Belgian company, with its registered office at 8900 Ypres, Zwaanhofweg 10, and registered with the Crossroads Bank for Enterprises under number 737.913.939, which offers Services, Products, and Tracks on the Leadlife Webshop as a preferred partner of Leadlife.


Customer
Any customer wishing to purchase Services, Products, and Tracks in the Leadlife Webshop.


Leadlife Webshop
The offering of Services, Products, and Tracks available on the Leadlife Website from Leadlife, Leadlife BV, and Leadlife Partners.


Leadlife Website
The Leadlife website, on which Services, Products, and Tracks are offered in the Leadlife Webshop, namely https://www.leadlife.com/.


Services
The full range of services available within the Leadlife Webshop from Leadlife, Leadlife BV, or Leadlife Partners.

Products
The full range of products available within the Leadlife Webshop from Leadlife, Leadlife BV, or Leadlife Partners.


Tracks
The full range of tracks available within the Leadlife Webshop from Leadlife, Leadlife BV, and Leadlife Partners, which may consist of a combination of various Products and/or Services.


Technical Sheet
The Technical Sheet is a digital sheet linked to a Service, Product, or Track that can be found on the Leadlife Website, associated with the respective Service, Product, or Track. It enables the Customer to obtain information about the specifications of a Service, Product, or Track from Leadlife, Leadlife BV, or a Leadlife Partner in an accessible and unambiguous manner. The Technical Sheet is an integral part of the purchase contract concluded between the Customer and Leadlife or Leadlife BV, or, if applicable, the Leadlife Partner upon the purchase of a Service, Product, or Track by the Customer.


(Leadlife) Partner
Any natural or legal person who is not a Customer, who is not Leadlife or Leadlife BV, but who offers Services, Products, or Tracks via the Leadlife Webshop on the Leadlife Website.


Partner Page
A page on the Leadlife Website where the Customer can easily consult additional information regarding the Partner. This page contains the contact details of the Partner, an extract of the Partner's general terms and conditions, and any other information that may be useful to the Customer regarding the Services, Products, or Tracks offered by the Partner.


Third Party(ies)
Any natural or legal person who is not a Customer, Leadlife, Leadlife BV, or a Leadlife Partner.


Healthcare Practitioner
Any professional referred to in the coordinated law of May 10, 2015, regarding the practice of healthcare professions.


(Professional) Care Practitioner
Any natural person who professionally offers care, including a professional who is not a healthcare practitioner.






Intellectual Property Rights
All currently known or future (i) copyrights, neighboring rights, and moral rights, (ii) trademark or service mark rights, (iii) trade secret rights, know-how, expertise, (iv) patents, patent rights, and industrial property rights, (v) layout design rights, design rights, (vi) supplementary protection certificates, (vii) trade and company names, domain names, database rights, lease rights, and all other industrial intellectual property rights or similar rights (whether registered or not), (viii) all registrations, registration applications, renewals, extensions, divisions, improvements, or reissues concerning these rights, and the right to apply, maintain, and enforce any of the above, in any case and in any legal jurisdiction worldwide, for as long as this protection applies.


GDPR
Regulation (EU) 2016/679 of the European Parliament and the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, also known as the General Data Protection Regulation (GDPR).


Personal Data
All information about an identified or identifiable natural person.


Privacy Policy
The privacy policy of Leadlife regarding the processing of data subjects in the context of the Leadlife Webshop and the Services, Products, and Tracks offered on it.


Agreement
This agreement, concluded between Leadlife and the Customer, based on these General Terms and Conditions.


Consumer
The natural person who is not acting in the exercise of his/her professional activity or a business.


Sampling Kit
The medical devices (for in vitro diagnostics) offered by Leadlife to the Customer for, among other things, cortisol, melatonin, and DNA measurements.


Article 3. Subject Matter


3.1 These General Terms and Conditions apply to the sale of Services, Products, and Tracks from Leadlife, Leadlife BV, and Leadlife Partners in the Leadlife Webshop. Furthermore, these General Terms and Conditions apply to every purchase order and to all deliveries.


3.2 All information regarding Leadlife's membership plans (Memberships) is described in the general terms and conditions of the Leadlife App.


3.3 To use the Services, Products, and Tracks offered in the Leadlife Webshop, the Customer must be at least 18 years old. Damage (whether direct or indirect) resulting from the (unauthorized) use by a minor Customer cannot be claimed from Leadlife. The Leadlife App is only available in Belgium.


3.4 The Services, Products, or Tracks include but are not limited to Sampling Kits, individual expert sessions, digital intakes, subscriptions.


Article 4. Purchase Order, Acceptance, and Payment


4.1 General provisions regarding purchases in the Leadlife Webshop


4.1.1 Leadlife reserves the right – within legal frameworks – to investigate whether the Customer can meet their payment obligations, as well as any facts and factors that are important for the execution of the purchase order. If Leadlife has reasonable grounds based on this investigation not to accept the purchase order, Leadlife is entitled to refuse a purchase order or to attach special conditions to its execution.


4.1.2 The Customer is obliged to report inaccuracies in provided or mentioned payment details to Leadlife without delay. Leadlife takes appropriate technical and organizational measures to secure the transfer of data and, if applicable, ensures a secure web environment. If the Customer makes electronic payments, Leadlife will take appropriate security measures.


4.2 Purchase of Services, Products, and Tracks from Leadlife and Leadlife BV via Leadlife


4.2.1 Through the Leadlife Website, the Customer has access to the Leadlife Webshop. Within this Leadlife Webshop, the Customer will be allowed to purchase, among other things, from Leadlife: in addition to the Services, Products, and Tracks of other Partners and possibly Leadlife itself, the Services, Products, and Tracks of Leadlife BV. The cost and associated price for a Product, Service, or Track from Leadlife and Leadlife BV are always clearly displayed in the Leadlife Webshop. Furthermore, for each Product, Service, and Track of Leadlife and Leadlife BV, all facilities and modalities included with the respective Product, Service, or Track will be clearly indicated. Memberships can also be obtained – where indicated – by purchasing Products, Services, and Tracks.


4.2.2 The displayed prices are shown in euros and always represent the unit price for the respective Product, Service, or Track.


4.2.3 The displayed prices of the Services, Products, and Tracks from Leadlife (where applicable), Leadlife BV, and other Leadlife Partners exclude any laboratory fees and fees that may be charged to the Customer by a Healthcare Practitioner and/or a (professional) Care Practitioner who must be consulted in the context of the chosen service. These fees are independently determined by the laboratory and/or the Healthcare Practitioner or (professional) Care Practitioner and must be paid separately to the respective actor. Healthcare Practitioners and (professional) Care Practitioners will always determine their fees in accordance with the Code of Medical Ethics. Leadlife will always do its utmost to clearly and unequivocally indicate when such additional costs may apply for Services, Products, and/or Tracks from Leadlife and Leadlife BV.


4.2.4 The purchase of Services, Products, and/or Tracks from Leadlife (where applicable), Leadlife BV, and other Leadlife Partners offered within the Leadlife Webshop is carried out via Leadlife.


4.2.5 Before proceeding to the actual payment of their Service, Product, or Track from Leadlife (if applicable), Leadlife BV, or other Leadlife Partners, the Customer will be provided with a clear overview of the payable price, as well as the terms associated with the purchase and any additional modalities and/or facilities specific to the purchased Product, Track, or Service from Leadlife (if applicable), Leadlife BV, or other Leadlife Partners. By proceeding to the actual payment module, the Customer explicitly agrees with the purchase order, as well as these General Terms and Conditions, which also govern the purchase and use of the Services, Products, and/or Tracks from Leadlife and Leadlife BV. More information on the right of withdrawal applicable to this Agreement can be found in Article 7 of these General Terms and Conditions.


4.2.6 Leadlife reserves the right to correct any errors in indicated prices without any liability arising from it.


4.2.7 The following payment methods are accepted, provided they remain supported by the payment provider: Bancontact, Visa, MasterCard, Maestro, American Express, PayPal, Belfius Direct Net, KBC/CBC Payment Button, and ING home'Pay. Payments are processed via Shopify (and the included Mollie payment facility). Leadlife will not receive direct payments from the Customer.


4.2.8 In addition to purchasing Services, Products, and Tracks from Leadlife and Leadlife BV via the Leadlife Webshop, the Customer can also purchase Services, Products, and/or Tracks via the Leadlife Catalogue in the Leadlife App. The general terms and conditions of the Leadlife App apply to these purchases.


4.3 Purchase of Services, Products, or Tracks from Leadlife Partners


4.3.1 Within the Leadlife Webshop, the Customer has the option to purchase Services, Products, and Tracks from Leadlife Partners.


4.3.2 Leadlife has a quality protocol in place for concluding partnerships, whereby Partners will be subject to a quality check before they can offer Services, Products, and Tracks within the Leadlife Webshop.







4.3.3 For the Services, Products, and Tracks of Leadlife Partners, a clear description of the modalities and facilities will always be provided in the Technical Sheet. For each Leadlife Partner, an extract of their general terms and conditions, a reference to the general terms and conditions, and contact details will also be provided on the Partner Page of the Leadlife Partner on the Leadlife Website. The purpose of this extract is to inform the Customer in an accessible and unambiguous manner about any deviations from the general terms and conditions of the Partner in comparison to these General Terms and Conditions. The Customer will be given the opportunity to consult the full general terms and conditions of the Partner in a simple and accessible manner.


4.3.4 The purchase of Services, Products, and/or Tracks from a Leadlife Partner offered within the Leadlife Webshop is carried out via Leadlife.


4.3.5 For questions regarding the delivery, execution, modification, cancellation, or cost of the Services, Products, and Tracks from a Partner, the Customer must contact the Partner using the contact details provided on the Partner Page. Leadlife acts in a purely distributing role, with minimal facilitating responsibility concerning the Services, Products, and Tracks of a Leadlife Partner.


Leadlife cannot be held liable for errors in any data provided by the Partner to Leadlife (see Article 12). For substantive questions related to personalized or non-personalized Services, Products, and Tracks from a Leadlife Partner, the Customer must contact the Partner in question. Only for technical questions regarding the Leadlife Webshop can the Customer contact Leadlife via support@leadlife.com.


4.3.6 The displayed prices are always shown in euros and represent the unit price for the specific Product, Service, or Track from the Leadlife Partner.


4.3.7 Before proceeding to the actual payment of their Service, Product, or Track from a Leadlife Partner, the Customer will receive a clear overview of the payable price, as well as the terms associated with the purchase and any additional modalities and/or facilities specific to the purchased Product, Track, or Service. The General Terms and Conditions of the Leadlife Partner cannot be stricter than those set out in these General Terms and Conditions unless otherwise specified in the Leadlife Partner's General Terms and Conditions. The Leadlife Partner will always clearly inform the Customer about the extent of any stricter provisions. By proceeding to the actual payment module, the Customer explicitly agrees with the purchase order, the General Terms and Conditions and Privacy Policy of Leadlife, and the general terms and conditions, any privacy policy, and/or additional conditions of the Leadlife Partner. More information on the right of withdrawal applicable to this Agreement can be found in Article 7 of these General Terms and Conditions.


Article 5. Delivery


5.1 Leadlife will carry out the delivery of the Services, Products, and Tracks with care, as far as it is responsible for the delivery.

If this is the case, Leadlife, together with Leadlife BV and/or a Leadlife Partner, will carry out the delivery with appropriate speed. The delivery times provided by Leadlife BV are indicative only, and no rights can be derived from them by the Customer.
If this is not the case, Leadlife will ensure that Leadlife BV or the relevant Leadlife Partner carries out the delivery with care and appropriate speed.


5.2 Delivery of Leadlife and Leadlife BV Products, specifically the Sampling Kit(s) and Products from Leadlife Partners


5.2.1 The delivery location of Leadlife or Leadlife BV Products will be agreed upon between Leadlife/Leadlife BV and the Customer via the designated channels. The delivery location of Leadlife Partner Products will be indicated in the Technical Sheet of the relevant Product or on the Partner Page.


5.2.2 Leadlife and Leadlife BV are not responsible for the consequences of incorrect information provided by the Customer. If the provided delivery address is incorrect or incomplete and a Leadlife or Leadlife BV Product (including Sampling Kits) or a Leadlife Partner Product needs to be re-shipped, additional costs will be charged to the Customer.


5.2.3 The following delivery methods are offered by Leadlife for the delivery of Leadlife and Leadlife BV Products: delivery of the Sampling Kit to an address provided by the Customer, to a BPost collection point, to a BPack collection point, to a Leadlife center collection point, or to a collection point selected by Leadlife. The Sampling Kits are only delivered in Belgium.


5.2.4 For the delivery of Leadlife Partner Products, the delivery methods and conditions are specified on the Partner Page.


5.2.5 The risk is transferred to the Customer at the moment the Leadlife or Leadlife BV Product is unloaded by the carrier, forwarder, or another person used for delivery. If the Leadlife or Leadlife BV Products are delivered damaged, Article 6 of these General Terms and Conditions must be followed. For warranty conditions for Leadlife Partner Products, the Customer can consult the Partner Page of the relevant Partner.


5.2.6 Products are offered at the delivery address provided by the Customer. If no one is available to receive the Product at the time of delivery, a delivery notice will be left. This notice will specify the address where the Customer can collect the Product. The Product will remain available to the Customer for fourteen (14) days after the day of delivery at this address. After this period, the purchased Product, if applicable, will be returned to Leadlife, Leadlife BV, or the relevant Leadlife Partner. In this case, the Customer may contact Leadlife, Leadlife BV, or the relevant Leadlife Partner to organize a new delivery at the Customer's expense.


The delivery of the purchased Product will take place no later than twenty (20) working days after the acceptance of the purchase order, unless a longer delivery period is indicated.

5.2.7 If the desired Leadlife or Leadlife BV Product is out of stock, Leadlife and Leadlife BV will make efforts to make it available again. Leadlife and Leadlife BV will inform the Customer by email of the (temporary) unavailability of this Leadlife Product, no later than fourteen (14) days after placing the purchase order. The Customer has the option to wait for the availability of this Product from Leadlife or Leadlife BV and/or to cancel the purchase order without additional costs. For Leadlife Partner Products, the Customer can find more information on the Partner Page.


If the Customer chooses to wait for the availability of this Leadlife or Leadlife BV Product, it will be shipped as soon as it becomes available. If the Product is not (or no longer) deliverable or if the Customer chooses to cancel the purchase order, Leadlife or Leadlife BV will refund the Customer the price of the Product within thirty (30) days after the Customer informs Leadlife of this choice.


5.3 Delivery of Leadlife and Leadlife BV Services and/or Tracks and Leadlife Partner Services and/or Tracks


5.3.1 If the Customer purchases a Service and/or Track via the Leadlife Webshop, the Customer will receive an activation code to activate the purchased Services and/or Tracks in the Leadlife App.


5.3.2 The Customer acknowledges that the delivery of the Services depends on any waiting times at the location where Services are offered, along with the availability of the Customer to schedule an appointment to use the Services. The Customer also acknowledges that the delivery of the Services may depend on the availability of Healthcare Practitioners and/or (professional) Care Practitioners. For questions regarding the delivery of Leadlife Partner Services, the Customer should contact the relevant Leadlife Partner via the contact details provided on the Partner Page.


5.3.3 Leadlife and Leadlife BV Services do not provide medical care and are not intended to replace any form of medical care. The purpose of the Services is to help the Customer understand their lifestyle and well-being and do not provide diagnoses for diseases or conditions. If the Customer suspects a medical emergency, they should immediately contact their Healthcare Practitioner, (professional) Care Practitioner, or emergency services.











5.4 Late cancellation of delivery of a Leadlife or Leadlife BV Product or Service by the Customer or a 'no-show' by the Customer and late cancellation of Leadlife Partner Products and Services


5.4.1 The Customer must cancel an appointment at least 48 hours in advance. This applies to scheduled appointments (physical or online) within Leadlife and Leadlife BV with either a Healthcare Practitioner or a (professional) Care Practitioner. If the Customer cancels within 48 hours of the scheduled appointment, does not show up at the agreed time, or is more than twenty minutes late to the scheduled appointment, no reimbursement of the Customer's already incurred costs can be provided. Leadlife or Leadlife BV also reserves the right to cancel the appointment if the Customer is late. The Customer may reschedule the appointment, but the costs for this additional or new appointment will be borne by the Customer.


5.4.2 If Leadlife must cancel a scheduled appointment (physical or online) with a Healthcare Practitioner or a (professional) Care Practitioner within 48 hours of the appointment, the Customer will be offered the option to either be reimbursed for the costs already incurred for this specific appointment or to reschedule the appointment, in which case the costs for rescheduling will be borne by Leadlife or Leadlife BV. Leadlife and Leadlife BV, however, reserve the right to deviate from the cancellation policy with compensation if the cancellation of a Healthcare Practitioner or a (professional) Care Practitioner results from a situation where the Healthcare Practitioner or (professional) Care Practitioner is called for an urgent intervention or is absent due to an accident or other force majeure situation.


5.4.3 The Customer acknowledges that the cancellation policy for Leadlife Partner Products and Services may vary according to the policy of the relevant Leadlife Partner. The cancellation policy of the Leadlife Partners can be found on the Partner Page of the specific Leadlife Partner.


Article 6. Warranty and Conformity


6.1 Information, images, oral statements, specifications, etc. regarding all offers and the main characteristics of the Services, Products, and Tracks that are provided by phone, email, (info)brochure, or online via the website www.leadlife.com or the Leadlife Website, are presented or made as accurately as possible. Leadlife is not liable for the advice provided by Leadlife BV or any of the Leadlife Partners, nor for printing and typographical errors on the Leadlife website or in the Leadlife Webshop.


6.2 The legal warranty applies only to the Products of Leadlife, Leadlife BV, and the Products of Leadlife Partners. The legal warranty period for Products that do not comply with the purchase order, the specifications mentioned in the offer, the reasonable requirements of reliability and/or usability, and the legal provisions and/or government regulations in force on the date of the purchase order is two (2) years. Within this period, Leadlife and Leadlife BV reserve the right to replace the Products. If replacement is not possible or disproportionate, Leadlife and Leadlife BV commit to refunding the payments received for the Product concerned.

If the Customer wishes to invoke their legal warranty period regarding Products from Leadlife Partners, the Customer must contact the relevant Leadlife Partner via the Leadlife Partner's contact details on the Partner Page.


Upon delivery, the Customer undertakes to verify whether the quality and quantity of the Products conform to the purchase order. Any complaint regarding visible defects or missing Products must be sent by email to customer service via info@leadlife.com, no later than two (2) days after delivery. If the Customer fails to file a complaint within this period, the Customer loses the right to file a complaint regarding visible defects or missing Products.


To invoke the warranty, the Customer must present the proof of purchase or invoice. The warranty is non-transferable. Any defect must be reported to the customer service of Leadlife and Leadlife BV via info@leadlife.com within two (2) months after its discovery. After this period, all warranty rights lapse. Customer service will inform the Customer of the steps to follow to return the Products. In any case, the return of Products can only occur after prior written confirmation from Leadlife and Leadlife BV.


The warranty cannot be claimed for defects resulting from: (i) fault or negligence of the Customer; (ii) repair or modification to the Product by the Customer or a Third Party; (iii) poor maintenance; (iv) careless use or use under abnormal conditions; (v) a cause inherent to the normal duration or lifespan of the Products; (vi) an external cause not attributable to Leadlife, Leadlife BV, or a Leadlife Partner; (vii) fault, negligence, or services from Third Parties.


Article 7. Right of Withdrawal


7.1 In accordance with Book IV of the Economic Law Code, every customer, in their capacity as a Consumer, has the right to withdraw from a purchase within 14 calendar days after the delivery of a Product or after the conclusion of the agreement relating to the provision of Services or digital content.


Certain Products from Leadlife, Leadlife BV, or a Leadlife Partner – specifically the Sampling Kits – must be considered an exception to the right of withdrawal as the delivery of the sealed Sampling Kit cannot be returned for hygiene reasons.


All information regarding the right of withdrawal related to the activation of a subscription plan (Membership) can be found in the general terms and conditions of the Leadlife App.

The Services of Leadlife and Leadlife BV must also be considered an exception to the right of withdrawal because (i) the Customer has agreed to the commencement of the Services from Leadlife and Leadlife BV and (ii) the Customer acknowledges that by doing so, they waive their right of withdrawal. Therefore, the Customer cannot claim a right of withdrawal concerning the ordered Services from Leadlife and Leadlife BV.




7.2 By agreeing to these General Terms and Conditions and completing the purchase in the Leadlife Webshop, the Customer confirms and accepts that they waive their right of withdrawal once the Services of Leadlife and Leadlife BV are provided by Leadlife and Leadlife BV. This means that the Customer, from that point onward, is obliged to comply with these General Terms and Conditions, without prejudice to the right to withdraw their consent for the processing of their Personal Data in accordance with the Privacy Policy.


7.3 Where the Services of Leadlife and Leadlife BV, the Leadlife Webshop, or the website www.leadlife.com use Services, Products, and Tracks from Leadlife Partners, the conditions of the relevant Leadlife Partner for the provision of Services, Products, and Tracks will apply. By purchasing Services, Products, or Tracks from a Leadlife Partner, the Customer accepts the general terms and conditions of the relevant Leadlife Partners, an extract of which can be found on the Partner Page. A reference to the full general terms and conditions of the Leadlife Partner in question will always be provided. Leadlife accepts no liability for the content of Third Party terms and conditions.


Article 8. Termination


8.1 All information regarding the termination of subscription plans can be found in the general terms and conditions of the Leadlife App.


8.2 All information regarding the termination of a Service and/or Track can be found in the General Terms and Conditions of the Leadlife App (particularly for Services and/or Tracks from Leadlife BV) or additionally in the General Terms and Conditions of the relevant Leadlife Partner.


Article 9. Liability


9.1 Leadlife makes reasonable efforts and uses all available resources to ensure that the Leadlife Webshop and the Services, Products, and Tracks offered on it are of high quality.

9.2 Leadlife conducts a quality check on the Services, Products, and Tracks offered by Leadlife BV and Leadlife Partners before they become (either free or paid) available in the Leadlife Webshop. Leadlife will make all reasonable efforts not to allow any Leadlife Partners who do not, with reasonable effort, deliver the same degree of quality associated with Leadlife Services, Products, and Tracks.


However, Leadlife is in no way liable if, during the use of a Leadlife BV Product or a Leadlife Partner's Product, or the execution of a Leadlife Partner's Service or Track, the quality of the Product, Service, or Track does not meet the stated quality. If the Customer notices that a Leadlife BV or Leadlife Partner Service, Product, or Track does not have or is not executed with the expected quality, they must first raise the issue with Leadlife BV or the relevant Leadlife Partner, who is fully responsible for delivering and guiding their own Services, Products, and Tracks.




Additionally, the Customer must notify Leadlife of the observed quality issue. Leadlife will make reasonable efforts to ensure the quality of the delivered Product or executed Service or Track and, if necessary, will take steps to improve this quality in the future. In no case can compensation be obtained through Leadlife for the lack of quality of a Leadlife BV or Leadlife Partner Service, Product, or Track.


If Leadlife is informed of problems regarding a Leadlife Partner or their Service, Product, or Track, Leadlife may take steps to remedy the situation as soon as possible.


9.3 Except as permitted by applicable law, Leadlife's liability under these General Terms and Conditions, with respect to any event (or series of connected events), shall not exceed the total fees paid by the Customer to Leadlife under these Webshop Terms.


9.4 Leadlife cannot, in any way, be held liable, either contractually or extra-contractually, for the discontinuation of the Services, Products, or Tracks of Leadlife BV and/or a Leadlife Partner. Regarding the Services, Products, and Tracks of Leadlife BV and Leadlife Partners, Leadlife is not liable in any way. All liability for Services, Products, and Tracks of Leadlife BV or Leadlife Partners lies respectively with Leadlife BV (according to the liability limitations in these General Terms) or the relevant Leadlife Partner.


9.5 Leadlife is in no case liable to the Customer for any indirect, punitive, special, consequential, or similar damages (including but not limited to damages for lost profits, revenue, data loss or corruption, loss of customers and contracts, goodwill, the cost of procuring substitute goods or services, reputational damage, work interruptions, damage to programs or other data on computer systems, equipment, software, or other), whether caused by negligence, breach of contract, breach of statutory duty, or otherwise. Each party has the duty to mitigate damages. The liability limitations under this article in favor of Leadlife shall also apply to its subcontractors and Leadlife Partners.


The Leadlife Webshop contains hyperlinks to websites and/or pages of Leadlife BV, Third Parties, and Leadlife Partners (including but not limited to licensors and other service providers), or may indirectly reference them. Placing links to these websites or pages in no way implies implicit approval of their content by Leadlife.


9.6 Leadlife makes efforts to keep the Leadlife Webshop accessible 24/7. Leadlife cannot be held liable for malfunctions, failures, or temporary or permanent unavailability of the Webshop. The Customer can never claim compensation for costs incurred or hold Leadlife liable for any form of damage arising directly or indirectly from accessing or using the Leadlife Webshop. The content of the Webshop can be taken offline, modified, or supplemented at any time, in whole or in part.


9.7 Any loss, material or physical damage, suffered by the Customer due to the actions, omissions, and/or medical advice of the Healthcare Practitioner and/or (professional) Care Practitioner within the therapeutic relationship with the Customer, falls outside the scope of these General Terms. It is governed according to applicable healthcare law and the professional liability of the Healthcare Practitioner and/or (professional) Care Practitioner. Leadlife (or Leadlife BV) cannot be held liable in any case.

The Customer expressly acknowledges and agrees that their use of the Services of Leadlife and Leadlife BV, Products, and/or Tracks of Leadlife and Leadlife BV, including the analysis of their data, is entirely at their own risk.


The Customer acknowledges and agrees that there are risks associated with transmitting and storing information on the internet, and that Leadlife is not responsible for any loss of their Personal Data, including but not limited to result reports and related user content.


9.8 Without prejudice to the preceding provisions and to the maximum extent permitted by applicable law, Leadlife's liability regarding or in connection with the Leadlife Webshop, Services, Products, and Tracks of Leadlife under these General Terms, whether in contract law, warranty law, tort law, or otherwise, is limited to the maximum amount covered by Leadlife's insurance policy on the date the relevant liability claim arises. Nothing in these General Terms limits or excludes our liability for (i) gross negligence; (ii) willful misconduct; (iii) fraud or personal injury.


9.9 Leadlife cannot be held liable for the accuracy, completeness, or precision of the information provided by a Customer concerning the Services, Products, and Tracks.


Article 10. Suspension


10.1 If Leadlife, its licensors, Leadlife BV, Leadlife Partners, and/or other involved service providers suspect that the Customer is in breach of these General Terms and Conditions or any other instructions, guidelines, or policies (including, but not limited to, the Privacy Policy) issued by Leadlife, the Customer's access to the Services, Products, and Tracks may be suspended or restricted. Such suspension will last until the Customer rectifies the breach that led to the suspension or restriction.


10.2 If the Customer fails to make timely payments, where applicable, Leadlife may automatically suspend the Customer's access to the Services, Products, and Tracks of Leadlife, Leadlife BV, and Leadlife Partners. The duration of this suspension will continue until the overdue payment is resolved.


Article 11. Intellectual Property and Usage Rights


11.1 All Intellectual Property Rights related to the Leadlife Webshop, the Services, Products, and/or Tracks of Leadlife, and any related software and/or provided supplementary documentation, belong to Leadlife and/or its licensors. Nothing in these General Terms constitutes a full or partial transfer of these Intellectual Property Rights to the Customer.


11.2 All Intellectual Property Rights related to the Services, Products, and/or Tracks of Leadlife BV, any related software and/or provided supplementary documentation, wherever and whenever exercised, belong to Leadlife BV and/or its licensors. Nothing in these General Terms constitutes a full or partial transfer of these Intellectual Property Rights to the Customer.

11.3 Upon acceptance of the purchase order as described in these General Terms, Leadlife grants the Customer a non-exclusive, personal, non-sublicensable, and non-transferable license to use the purchased Services and Tracks of Leadlife in accordance with these General Terms.


11.4 Upon acceptance of the purchase order as described in these General Terms, Leadlife BV grants the Customer a non-exclusive, personal, non-sublicensable, and non-transferable license to use the purchased Services and Tracks of Leadlife BV in accordance with these General Terms.


11.5 The Customer is not permitted to use the Services, Products, and Tracks of Leadlife and Leadlife BV for commercial purposes unless written, prior, and explicit consent is obtained from Leadlife, nor is the Customer allowed to use the Services, Products, and Tracks of Leadlife or Leadlife BV, or any part thereof, in any way for which Leadlife has not granted written, prior, and explicit consent. The Customer must use the Services, Tracks, and Products strictly in accordance with (i) these General Terms, (ii) any additional instructions or policies issued by Leadlife, including but not limited to what is posted in the Leadlife Webshop or on the Leadlife Website, (iii) all applicable laws and regulations, and (iv) any provided supplementary documentation. Regarding the use of Leadlife Partner Services, Products, and Tracks, the Customer must comply with the general terms and conditions of the relevant Leadlife Partner as well as any additional instructions or policies issued by the Leadlife Partner.


11.6 The Customer agrees not to, and will not attempt to, directly or indirectly:


(i) bring any Services, Products, and/or Tracks and related software, in whole or in part, back to the source code (reverse engineering), copy or modify it;

(ii) assign, sell, transfer, lease, rent, trade, or encumber the Services, Products, and/or Tracks or any related software, make it available to a Third Party, or use the Services, Products, and/or Tracks or any related software on behalf of a Third Party, unless explicitly permitted by written consent from Leadlife or a Leadlife Partner regarding Leadlife Partner Services, Products, and Tracks;

(iii) create derivative works based on the Services, Products, and/or Tracks or any related software;

(iv) modify, remove, delete, or obscure any copyright notices, Intellectual Property Rights marks, digital watermarks, proprietary legends, or other notices in the Services, Products, and/or Tracks, any related software, or provided supplementary documentation;

(v) intentionally distribute worms, Trojan horses, corrupted files, or other destructive or misleading items, or use the Services, Products, and/or Tracks, any related software, or provided supplementary documentation for any unlawful, invasive, infringing, defamatory, or fraudulent purposes;

(vi) remove or otherwise circumvent technical or other protective measures in the Services, Products, and/or Tracks, any related software, or provided supplementary documentation;

(vii) use the Services, Products, and/or Tracks, any related software, or provided supplementary documentation to generate unsolicited email advertisements or spam;

(viii) use any high-volume, automated, electronic, or manual processes to access, search, or harvest information in the Services, Products, and/or Tracks, any related software, or provided supplementary documentation (including, without limitation, robots, spiders, or scripts).


Article 12. Right to File Complaints


12.1 The Customer may contact Leadlife regarding any objection concerning the Leadlife Webshop and – in general – the Services, Products, and/or Tracks offered on it or these General Terms and Conditions.


12.2 In the event of a dispute concerning the Leadlife Webshop or these General Terms, Leadlife requests that the Customer contact them before taking any other action, so that the possibility of an amicable settlement can be explored.


12.3 In the event of a dispute concerning the Services, Products, and/or Tracks of Leadlife BV or these General Terms, Leadlife BV requests that the Customer contact them before taking any other action, so that the possibility of an amicable settlement can be explored.


12.4 If an amicable settlement does not resolve the issue, the Customer may contact the Federal Consumer Ombudsman Service.


Article 13. Processing of Personal Data and Privacy


Leadlife attaches great importance to the Customer's privacy and, when processing the Customer's Personal Data, complies with the applicable GDPR and relevant implementing laws. In the Privacy Policy, the Customer can find an explanation of how Leadlife obtains and processes their Personal Data.


Article 14. Force Majeure


14.1 Leadlife cannot be held liable for any damage suffered by the Customer as a result of force majeure, which is an unavoidable and unforeseeable cause or circumstance beyond Leadlife's control or as otherwise defined under Belgian law.


14.2 If Leadlife or Leadlife BV invokes force majeure, they will inform the Customer in writing as soon as reasonably possible, specifying the force majeure and its estimated duration, and will take all reasonable steps to mitigate the consequences of the force majeure. Leadlife will also notify the Customer when the force majeure ends.








14.3 Even during a possible pandemic or other national or international crisis, Leadlife will make reasonable efforts to properly deliver the Services, Products, and Tracks of Leadlife and Leadlife BV. Regarding the Services, Products, and/or Tracks of a Leadlife Partner, the Customer should contact the relevant Leadlife Partner. If the delivery of Services, Products, and/or Tracks is delayed or otherwise disrupted due to – even partially due to – the possible pandemic, national or international crisis, Leadlife shall not be liable for damages, indemnifications, or penalties owed to the Customer concerning the non-performance or improper performance of the Services, Products, and/or Tracks of Leadlife and Leadlife BV.


Article 15. Transfer


15.1 Leadlife has the right at any time to transfer the Agreement with the Customer to any of its affiliated companies.


15.2 For the purposes of this article, affiliated companies are considered to be any entity that controls, is controlled by, or is under common control with Leadlife.


15.3 For the purposes of this article, control or being controlled is defined as Leadlife, directly or indirectly, having the power to determine or cause the determination of the management and policies of another entity through the ownership of voting securities, by contract, or otherwise.


Article 16. Severability


If any provision of these General Terms is declared invalid, void, or unenforceable for any reason, the remaining provisions of these General Terms shall remain in full force and effect, and the invalid, void, or unenforceable provision shall be deemed amended to the fullest extent permitted by law so that it remains valid and enforceable.


Article 17. Waiver


Failure to enforce any provision of these General Terms shall never constitute a waiver of the rights and/or obligations under that or any other provision.


Article 18. Governing Law – Competent Court


These General Terms are exclusively governed by and must be interpreted in accordance with applicable Belgian law, without regard to any conflict of law principles or rules. The courts of the judicial district of East Flanders, Ghent division, shall have exclusive jurisdiction if any dispute arises concerning the Leadlife Webshop, the Services, Products, and/or Tracks of Leadlife or Leadlife BV, or these General Terms. If a dispute arises concerning the Services, Products, and/or Tracks of Leadlife Partners, the Customer acknowledges that the general terms of the Leadlife Partner must be the starting point for resolving the dispute amicably, and, where appropriate, the correct procedures for submitting the dispute must be followed.
